Walter Delgatti Neto, widely known as the 'hacker de Araraquara', has been released from custody. His departure from the Penitenciária 2 de Potim in São Paulo state occurred on Friday afternoon, following a key judicial decision.

The release was authorized by Supreme Court Justice Alexandre de Moraes. The justice approved Delgatti's progression from a semi-open prison regime to an open one. This decision was officially published on Thursday, May 7th.

Delgatti had been serving his sentence in a semi-open facility. His conviction stemmed from his role in hacking into the systems of Brazil's National Council of Justice (CNJ). The case brought him significant notoriety, particularly linked to the 2019 Operation Spoofing investigation.

In granting the progression, Justice Moraes cited Delgatti's fulfillment of the requirements under Brazil's Penal Execution Law. These include serving the minimum required time and demonstrating good conduct while incarcerated.

The transition to an open regime comes with a stringent set of court-mandated conditions. Delgatti is now required to wear an electronic ankle monitor at all times. He is also prohibited from using any social media platforms.

Additional restrictions include a mandatory nightly curfew on weekdays and a full-time curfew on weekends and public holidays. He must also prove he is engaged in lawful employment and report to the justice system on a weekly basis.

Delgatti's defense team stated they received the decision with serenity. They emphasized that the benefit represents a technical recognition of his strict compliance with all legal requirements for sentence progression.

The lawyers highlighted his excellent behavior in prison, which was classified as 'optimal' by the facility. They also noted his commitment to resocialization through study and reading, which contributed to his sentence reduction through approved performance on the Enem PPL exam. Based on reporting from g1.
