An 81-year-old gynecologist in Paraná, Brazil, was arrested for alleged sexual abuse of a patient in labor but was released by court order due to his age, which also shortened the statute of limitations.

In a case that has sent shockwaves through the medical community in Paraná, Brazil, an 81-year-old gynecologist named Felipe Lucas was taken into custody on Wednesday. The arrest stemmed from accusations that he sexually abused a patient who was in active labor at a facility in Teixeira Soares. The allegations are severe, with the doctor being charged with rape of a vulnerable person, as authorities believe he exploited the patient's condition to prevent any resistance.

The situation took a dramatic turn just one day later. On Thursday, the judiciary issued a ruling to release the doctor from preventive detention. The decision came after a successful petition from his defense attorneys, who argued that the arrest was both unjust and unnecessary. Their primary contentions were that the doctor was merely performing a routine obstetric procedure and that the alleged incidents under investigation occurred approximately 15 years prior.

A critical factor in the court's decision was the defendant's advanced age. Because Dr. Lucas is over 70 years old, Brazilian law mandates that the statute of limitations for the case is automatically reduced by half. This legal provision effectively cut the time limit for prosecution from the standard 20 years down to 10 years, a significant reduction that influenced the judicial calculus regarding his continued detention.

The initial complaint that triggered the investigation came from a 24-year-old woman. She reported to police that during a gynecological exam in early February, the doctor performed inappropriate intimate massages, falsely claiming it was a medical technique to stimulate libido. She also described the profound humiliation of being left exposed on the examination table while the doctor took a personal phone call for several minutes. Her formal complaint was filed a week after the incident, following a period of severe emotional distress and confirmation from other healthcare professionals that the procedures were not standard.

The investigation quickly uncovered a pattern. At least three other women have since come forward with similar allegations of sexual abuse during medical examinations. One woman reported an incident from 2011, and another from 2016. The accounts describe prolonged, inappropriate touching and repeated unnecessary internal examinations that caused significant pain. Investigators noted a striking convergence in the details provided by these victims, who do not know each other, suggesting a consistent modus operandi over many years.

Authorities have highlighted the doctor's influential background as a key reason why victims were hesitant to report the abuse sooner. Dr. Lucas is not only a medical professional but also a former state deputy, former mayor, and former city councilman in the region of Irati. Victims told police they feared his political influence and believed that filing a complaint would be futile. The police investigation also revealed that the doctor made no clinical notes whatsoever for the initial victim's visit, a serious breach of medical protocol that raised further suspicions.

The case has prompted action from medical oversight bodies. The Regional Medical Council of Paraná (CRM-PR) had previously honored Dr. Lucas in 2024 for completing 50 years of practice. Following the allegations, the council announced it would open a formal inquiry. Meanwhile, the Public Ministry of Paraná has supported a request for the doctor's provisional suspension from practicing medicine and from his public health functions, a decision that is still pending from the state court.
