Caruaru to Reserve 2-5% of Education Jobs for Trans PeopleThe Ministry of Public Prosecution of Pernambuco (MPPE) has recommended that the City of Caruaru establish a law to reserve between 2% and 5% of vacancies in public competitions and simplified selections within the Education sector for transgender people and travestis.
The recommendation allows for the measure to be implemented either through a law or a decree by the Executive branch, with a 60-day deadline for adoption. Participation in the reserved vacancies is optional and must be declared at the time of registration.
A key component of the recommendation is the establishment of a humanized heteroidentification procedure. This process will be based on self-declaration, which will be validated by a special committee. The recommendation explicitly prohibits the requirement of medical or psychiatric reports from candidates.
The policy also includes a provision for candidates who meet more than one affirmative action criterion, allowing them to compete simultaneously in different categories.
The initiative is grounded in decisions of the Federal Supreme Court (STF), notably the judgment of the Direct Action of Unconstitutionality by Omission 26, which recognized transphobia as a form of discrimination equivalent to racism.
