Justice Moraes argued that the Supreme Court should prohibit state legislative assemblies from revoking the arrests of state deputies who have been imprisoned for crimes unrelated to their official mandate. His defense is grounded in a specific and striking set of data.

Citing the figures, Moraes pointed out that in 13 instances where state parliamentarians were arrested for infractions not connected to their parliamentary duties, 12 of those arrests were subsequently revoked. This represents an overturn rate of over 92 percent.

The data further highlights a regional concentration, with eight of these 12 revocations occurring specifically in the state of Rio de Janeiro. This statistic underscores a potential pattern in how state legislatures have exercised their power to intervene in judicial matters concerning their members.
