Brazilian Supreme Court Justice Proposes Ban on Overturning State Legislator ArrestsIn a significant move concerning the separation of powers and judicial authority in Brazil, Supreme Court Justice Alexandre de Moraes has defended a proposal to prohibit state legislative assemblies from revoking the arrests of state deputies detained for crimes unrelated to their official mandates.

The proposal, presented by Justice Moraes, aims to address what he describes as a pattern of legislative interference with judicial decisions. To support his argument, the Justice cited specific data: out of 13 instances where state legislators were arrested for infractions unrelated to their mandate, 12 of those arrests were subsequently overturned by their respective state assemblies.

A notable concentration of these cases was identified in the state of Rio de Janeiro, where eight of the 12 revocations occurred. This statistic underscores the regional focus of the issue the proposed measure seeks to correct.

The core of Justice Moraes's defense rests on the principle that the judiciary's authority to order arrests, when following due legal process, should not be subject to political reversal by the legislative branch, particularly when the alleged crimes are not connected to the legislator's official duties or speech.

If adopted, such a measure would represent a clear delineation of powers, reinforcing the judiciary's role in criminal matters and limiting the scope of legislative immunity in cases of serious criminal allegations. The proposal is expected to spark debate within Brazil's legal and political circles regarding the balance between legislative privilege and the rule of law.
